SPORTS ACT - 1976 (SMCD 54)

    Section - 7 - Tenure of Office of Members of National Council.

    (1) Members of the National Council other than the Executive Chairman and the representative of the Ministry responsible for Sports, shall hold office for a period of two years.

    (2) Any such member may resign his office by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.

    (3) Any person who is a member of the National Council by virtue of paragraph (b) or (d) of section 5 of this Decree, shall cease to be a member upon his nomination being cancelled by the authority responsible for his nomination to the National Council, by writing addressed to the Executive Chairman, who shall forthwith communicate such information to the Commissioner.

    (4) Any member of the National Council other than the Executive Chairman, may be removed by the Commissioner from such membership if the Commissioner is satisfied that it is in the public interest so to do.

    (5) Where the office of a member of the National Council other than that of the Executive Chairman becomes vacant for any reason before the expiry of his term of office (if any), the Executive Chairman shall notify the authority responsible for his appointment or nomination of such vacancy and shall also, if the Commissioner is not that authority, notify the Commissioner thereof.

    (6) Where any such vacancy occurs, the Commissioner or such other authority may appoint or nominate as the case may be, a person to fill the vacancy.

    (7) Any person so appointed or nominated other than a person nominated under paragraph (b) of section 5 of this Decree, shall hold office for the unexpired portion of the previous holder's term of office.

    (8) Where any member of the National Council is incapacitated by reason of his absence from Ghana or illness or any other sufficient cause from the performance of the duties of his office, the Executive Chairman shall forthwith notify such information to the authority responsible for the appointment or nomination of that person and that authority may appoint or nominate another person to act in the place of that member until his incapacity has terminated or until the expiry of his term of office whichever first occurs.

    (9) Subject to the provisions of this Decree, where the offices of Chief Executive and Executive Chairman are vacant or if the Executive Chairman and Chief Executive is for any reason unable to perform the functions of these offices, the Chief Administrative Officer referred to in section 29 of this Decree shall act in both offices until the vacancy in the office of Chief Executive is filled or until the first mentioned officer is able again to perform those functions.

    (10) Subject to the provisions of this Decree, any person ceasing to hold office as a member shall be eligible to be re-appointed or re-nominated as the case may be to the National Council.
